This Privacy Policy (the “Privacy Policy”) describes AutoKitteh Inc. (“AutoKitteh”, “we”, “our”, or “us”) practices for processing Personal Data on our web application named “AutoKitteh”, including the Beta version.

AutoKitteh is a serverless workflow automation platform designed to facilitate users processes and free up time. With a few simple steps, the user can easily be able to automate repetitive tasks, connect apps, and manage workflows.(“Application”).

When we use the term “Personal Data” in this Privacy Policy, we mean (i) information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person, consumer or household; and (ii) any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly.

We collect, access, use, process, share and store Personal Data concerning or provided by developers who use and access our Application (“Users” or “you”).

Please read this Privacy Policy carefully and make sure you fully understand our practices before you access or use our Application. If you are opposed to our practices, you must immediately avoid or discontinue all use of the Application. 1. GENERAL PROVISIONS

1.1 We hereby inform you, and you hereby acknowledge that you have no legal obligation to provide us with any Personal Data when you use the Application, and the provision of it is solely based on your free will.

1.2 During your use of the Application, we ask you not to provide or upload any individual’s personal data when you build your code and specially not sensitive personal data. If you decide to include personal data, please ensure that such personal data has been legally collected, including that individuals have been informed and have provided their consent to the processing of their personal data, if legally required. Please note that since we do not control and have no visibility regarding the personal data you upload we cannot provide specific safeguards and measures.

We automatically collect certain technical data when you visit and interact with our Application, including, your Internet protocol (IP) address used to connect your computer to the internet, domain name, the type of device used to connect to the Application and country.

This data is automatically collected from the Application and might be collected directly by us or through our use of third parties' cookies and other tracking technologies.

3. WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

3.1 We share the Personal Data described above in the following instances:

3.1.1 With service providers and sub-contractors. We share Personal Data with our authentication service provider for the purpose of assisting us in login to the Application.

3.1.2 With analytics providers. We share your internet and other electronic network activity information with third party analytics providers that conduct analytics on our Application.

3.1.3 Corporate Transactions. We may share Personal Data in connection with any proposed or actual reorganization, restructuration, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of AutoKitteh business, assets or stock (including in connection with any bankruptcy, insolvency or similar proceedings).

3.1.4 Governmental, Administrative or Judiciary Authorities. We may disclose Personal Data in case of a subpoena, search warrant or court order (or similar requirement), or in compliance with applicable laws and regulations. Such disclosure or access may occur if we believe in good faith that: (a) we are legally compelled to do so; (b) disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing; or (c) such disclosure is required to protect our legitimate business interests, including the security or integrity of our Application.

3.1.5 Lawyers and Interested Parties. We will share Personal Data in case of the management of possible disputes and other legal matters where appropriate.

3.1.6 Virtual Stores. To the extent required, we will share certain Personal Data with Virtual Stores, in order to comply with our contractual obligations pertaining to the use of the Virtual Stores.

3.2 We will not sell or otherwise disclose Personal Data for monetary or other consideration to any third parties (and have not done so over the last twelve (12) months).

3.3 We will not share your Personal Data for cross-contextual behavioral advertising (and have not done so over the last twelve (12) months).

4. HOW IS YOUR PERSONAL DATA TRANSFERRED OUTSIDE OF YOUR COUNTRY?

4.1 We may process Personal Data in various sites worldwide.

4.2 European Economic Area (“EEA”) Transfers. When we transfer Personal Data from within the EEA to countries or international organizations that are based outside the EEA, the transfer takes place on the basis of an adequacy decision by the European Commission, or in the absence of an adequacy decision, other legally permitted safeguards, such as standard contractual clauses (“SCCs”).

4.3 Israeli Transfers. When we transfer Personal Data from Israel to a third country, the transfer takes place on the basis of an adequacy decision by the Israeli Privacy Protection Authority, or in the absence of an adequacy decision, by using the Application, you hereby provide your informed consent to the transfer of your Personal Data to countries outside Israel, in which the level of data protection may not be as protective as the level in Israel.

5. RIGHTS REGARDING YOUR PERSONAL DATA

5.1 General Provisions

5.1.1 Individuals have certain rights regarding their Personal Data, depending on their jurisdiction. If you wish to exercise your rights, you may contact us at support@autokitteh.com. We will consider all such requests and provide our response within a reasonable period (and in any event within any time period required by applicable laws).

5.1.2 When you ask us to exercise any of your rights under this Privacy Policy and the applicable laws, we may need to ask you to provide us with certain credentials to make sure that you are who you claim you are, to avoid disclosure to you of Personal Data which is related to others that you are not authorized to receive, and to ask you questions to better understand the nature and scope of Personal Data that you request to access.

5.1.3 We may redact from the Personal Data we will make available to you any Personal Data related to others.

5.2 Rights for Israeli Users. If you are based in Israel, you are entitled to request us to:

5.2.1 review your personal data that we process.

5.2.2 update, amendment, and deletion of personal data which is incomplete or outdated.

5.3 Rights for EEA Users. If you are based in the EEA, you are entitled to request us to:

5.3.1 access your Personal Data in order to obtain clear, transparent and understandable information on how we process your Personal Data and on your rights (as provided in this Privacy Policy), as well as a copy of your Personal Data.

5.3.2 rectify your Personal Data in case your Personal Data are obsolete, inaccurate or incomplete.

5.3.3 object the processing of your Personal Data when the processing is based on AutoKitteh’s legitimate interest. Autokitteh will no longer process your Personal Data unless Autokitteh demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, such as the respect of a legal obligation (e.g. legal obligation involving the retention of documents), or for the establishment, exercise or defense of legal claims.

5.3.4 in certain circumstances under applicable laws, restrict the processing of some of your Personal Data during a limited period of time.

5.3.5 withdraw your consent when it has been obtained and processing is based on consent.

5.3.6 in certain circumstances under applicable laws, request data portability, meaning that you can receive the Personal Data originally provided by you in a structured and commonly used format or that you can request the transfer of the Personal Data provided by you to another data controller.

5.3.7 in certain circumstances under applicable laws, delete your Personal Data (also known as the right to be forgotten).

5.3.8 lodge a complaint to your national data protection authority. If you have a complaint about how we use your Personal Data, we would always prefer you to contact us first. However, you may also make a complaint to your local data protection authority in the EEA. If you are unsure which data protection authority to contact, please contact us at support@autokitteh.com.

5.4 Data Rights for California Users. If you are a California resident, you are entitled:

5.4.1 to request what Personal Data we have collected, including the categories of Personal Data, the categories of sources from which the Personal Data is collected, the business or commercial purpose for collecting, selling, or sharing Personal Data, the categories of third parties to whom we disclose Personal Data, and the specific pieces of Personal Data we have collected about you.

5.4.2 to request the deletion of your Personal Data, subject to certain exceptions.

5.4.3 to request the correction of your inaccurate Personal Data.

5.4.4 to the extent applicable, you have the right to opt-out of the “sharing” of your Personal Data for “cross-contextual behavioral advertising,” often referred to as “interest-based advertising” or “targeted advertising.”

5.4.5 to the extent applicable, you have the right to opt-out of the sale of your Personal Data to third parties.

5.4.6 under certain circumstances and to the extent we use or disclose “sensitive personal information” (SPI), you have the right to limit the use or disclosure of SPI.

5.4.7 you may request to receive a copy of your Personal Data, including specific pieces of Personal Data, including, where applicable, to obtain a copy of the Personal Data you provided to us in a portable format.

5.4.8 to not receive discriminatory treatment if and when you exercise your rights regarding your Personal Data.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your Personal Data. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.

6. HOW LONG DO WE STORE YOUR PERSONAL DATA FOR?

6.1 We retain Personal Data for as long as necessary to provide our Application and until you request to delete your account.

6.2 Other circumstances in which we will retain your Personal Data for longer periods of time include: (i) where we are required to do so in accordance with legal requirements, or (ii) if we reasonably believe there is a prospect of litigation.

7. HOW DO WE KEEP YOUR PERSONAL DATA SECURE?

7.1 AutoKitteh has implemented technical and organizational measures compliant with and industry standards to protect Personal Data, in particular against potential data breaches, either by accident or unlawfully, and against the destruction, loss, modification, unauthorized access or divulgation. However, we do not promise or guarantee that any Personal Data will be absolutely protected from unauthorized disclosure or use.

7.2 If you have found a vulnerability or would like to report a security incident, you may send an email to security@autokitteh.com.

8. DOES THIS PRIVACY POLICY APPLY TO THIRD PARTY LINKS?

8.1 You may, during your use of the Application, access links to other websites or applications operated by third parties. Please note that this Privacy Policy only applies to Personal Data that we (or third parties on our behalf) collect or otherwise process from or about you and we cannot be responsible for Personal Data collected or otherwise processed by third parties.

8.2 Third party websites and applications have their own terms of use and privacy policies, and you should read these carefully before you submit any Personal Data to these websites or applications. We do not endorse or otherwise accept any responsibility or liability for the content of such third-party websites or third-party terms and conditions or privacy policies.

9. SOCIAL MEDIA WIDGETS

9.1 Our Application may include social media features, such as the Gmail™ and GitHub™ buttons. These features will collect your IP address . They will also set a cookie to enable the feature to function properly.

9.2 Social media features are hosted by a third party. Your interactions with these features are governed by the privacy policy of the company, social media platform or third-party service, providing it.

10. WHAT IS OUR POLICY REGARDING MINORS?

10.1 The Application is not intended for use by minors and we do not knowingly collect and process Personal Data relating to minors. If these age requirements are not met, you are required to avoid using the Application.

10.2 We will discard any Personal Data we receive from a minor immediately upon discovering that such a user shared Personal Data with us.

11. HOW DO WE APPROACH CHANGES TO THIS PRIVACY POLICY?

11.1 We will change this Privacy Policy from time to time.

11.2 Any changes we make to our privacy policy in the future will be posted on this page and, if we have your email address, we may also notify you by email of any material changes.

11.3 The effective date of any change of Privacy Policy will be clearly marked on the top of each new Privacy Policy posted. We strongly encourage you to review this Privacy Policy periodically to ensure that you understand our most updated privacy practices.
